TERMS OF SERVICE – AVA JEWELLERY

Article 1 – Definitions
In these Terms of Service, the following definitions apply:
Consumer – A natural person acting for purposes outside their trade, business, or profession.
Company – The business offering products through the online store.
Distance Contract – A contract concluded between the Company and the Consumer through the online store without a physical meeting.
Right of Withdrawal – The Consumer's right to cancel a purchase within the legally prescribed period.
Online Store – The Ava Jewellery website and online store.
Product – Any item offered for sale through the Online Store.

Article 3 – Applicability
These Terms of Service apply to all offers, orders, and distance contracts made through Ava Jewellery.
By placing an order, the customer confirms that they have read, understood, and agreed to these Terms of Service.
Article 4 – Products and Pricing
All products displayed on the Website are subject to availability.
We reserve the right to modify products, prices, descriptions, and content at any time.
Prices displayed on the Website are shown in Canadian Dollars (CAD).
Applicable taxes, if required by law, will be displayed during checkout.
Shipping costs, if applicable, will be clearly displayed before the customer completes the purchase.
In the event of obvious pricing errors, technical errors, or system malfunctions, we reserve the right to cancel an order and issue a full refund.
Article 5 – Formation of the Agreement
A purchase agreement is considered concluded when:
- The customer places an order;
- Payment has been successfully received;
- The customer receives an order confirmation by email.
We reserve the right to refuse or cancel orders for legitimate reasons, including suspected fraud, payment issues, or product unavailability.
Article 6 – Right of Withdrawal and Returns
Customers located in jurisdictions where consumer protection laws provide cancellation rights may exercise those rights in accordance with applicable law.
In addition, Ava Jewellery voluntarily offers a 30-day return period from the date of delivery.
To qualify for a return, products must:
- Be unused and unworn;
- Be free from damage;
- Include original packaging whenever possible;
- Be returned in the same condition in which they were received.

Article 7 – Refunds
Refunds will be issued using the same payment method used for the original purchase.
Once the returned product has been received and inspected, refunds will be processed within 14 days.
If a return is made at the customer's discretion, return shipping costs are the responsibility of the customer unless otherwise required by applicable law.
For defective, damaged, or incorrect products, reasonable return shipping costs will be reimbursed.
Article 8 – Payments
The Online Store may offer payment methods including major credit cards, debit cards, and other payment options provided through authorized payment providers, including Shopify Payments.
All payments are processed through secure encrypted connections.
Ava Jewellery does not store complete payment card information.
Article 9 – Customs Duties and Import Charges
Orders shipped internationally may be subject to:

- Local sales taxes;
- Other government-imposed fees.
Unless otherwise stated at checkout, these charges are the responsibility of the customer.
Ava Jewellery is not responsible for customs delays or fees imposed by authorities in the destination country.

Ava Jewellery guarantees that products delivered will:

- Meet reasonable quality expectations;
- Comply with applicable consumer protection laws.
If a product is defective or faulty, customers may be entitled to repair, replacement, refund, or other remedies as required by applicable law.
Customers should notify us of defects within a reasonable period after discovering them.
Article 11 – Shipping and Delivery
Orders are generally processed within 1–3 business days.
Estimated delivery times are typically between 5–14 business days unless otherwise stated.
Delivery times are estimates and are not guaranteed.
Customers will receive shipping confirmation and tracking information, where available, once an order has been dispatched.
Ava Jewellery is not responsible for delays caused by shipping carriers, customs authorities, force majeure events, or circumstances beyond our reasonable control.

Article 13 – Limitation of Liability
To the maximum extent permitted by applicable law, Ava Jewellery's liability is limited to the value of the purchased product.
We are not liable for indirect, incidental, consequential, or special damages, including loss of profits, except where prohibited by law.
Nothing in these Terms limits any mandatory consumer rights provided by applicable legislation.
Article 14 – Governing Law and Dispute Resolution
These Terms of Service shall be governed by the laws of the Netherlands, except where mandatory consumer protection laws provide otherwise.
Consumers residing in Canada, the European Union, or other jurisdictions retain any mandatory rights granted under applicable consumer protection legislation.
Any dispute arising from these Terms shall be submitted to the competent courts of the Netherlands unless mandatory law requires otherwise.
